These General Conditions govern the purchase of products carried out remotely via telematic network through the website www.equiasa.it, owned by EQUIASA, with registered office at Via San Pellegrino 1, 25065 Lumezzane (BS).
Purchases are governed by Legislative Decree no. 206/2005 (Consumer Code) and, with regard to privacy protection, by EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003, where applicable.
Currently, the sales methods provided on the website www.equiasa.it are as follows:
– Minimum order: none;
– Shipping: available within Europe;
– Invoicing: companies must have a VAT number and correctly complete all required fields during the order phase.
For each order placed, EQUIASA issues an invoice for the shipped material, which will be sent by e‑mail to the order holder. The data provided by the customer at the time of order will be used for issuing the invoice. No changes will be possible after the fiscal document has been issued.
The conditions indicated in the introduction constitute an integral and essential part of this contract.
The contract is concluded exclusively online by accessing the website www.equiasa.it, where the customer can follow the instructions to complete the purchase of the desired product.
The customer is required to read and accept these general sales conditions before completing the order procedure. Sending the order confirmation implies full knowledge and complete acceptance of these conditions.
Pursuant to Article 66‑bis of Legislative Decree 206/2005, for any disputes the competent court is that of the consumer’s place of residence or domicile, if located within Italian territory.
All products are in condition equivalent to new. As they are handmade, they may show slight marks or scratches caused by contact with aluminum shavings. Such imperfections do not in any way affect the functionality or effectiveness of the product.
The prices of the products indicated on the website www.equiasa.it are expressed in Euros (€) and include VAT. For EU companies and non‑EU entities, the indicated prices are to be understood as net of taxes.
Shipping costs and any additional costs are not included in the indicated price and will be communicated before confirming the purchase.
The contract is finalized with the correct completion of the order form and the expression of consent to purchase through online confirmation.
EQUIASA undertakes to deliver the products to the address indicated by the customer, using third‑party couriers.
The risk of damage or loss of the goods remains with EQUIASA during shipment and transfers to the customer only at the moment of physical receipt of the goods, by the customer or by a third party designated by them.
If the customer chooses a carrier other than those proposed by EQUIASA, the risk transfers at the moment of delivery to the carrier itself (Art. 63 Legislative Decree 206/2005).
EQUIASA is not responsible for disruptions due to force majeure events such as accidents, explosions, fires, strikes, earthquakes, floods, or other events that prevent proper execution of the contract within the expected time.
EQUIASA is not liable for any fraudulent use of credit cards or other payment methods by third parties. During purchase, payment information is handled directly by the banking service via secure connection and is never visible to EQUIASA.
The customer undertakes not to enter false, incomplete, or fictitious data in the registration or order procedure. EQUIASA declines all responsibility for the correct issuance of fiscal documents in case of errors in the data provided by the customer, who is solely responsible for them.
The customer may exercise the right of withdrawal by following the instructions in the dedicated “Right of Withdrawal” section on the website www.equiasa.it.
The availability of products displayed on the website is indicative. In exceptional cases, simultaneous orders by multiple customers may occur. In such cases, EQUIASA reserves the right to verify the actual availability of the product and, if unavailable, to promptly inform the customer of the possible non‑acceptance of the order, proposing possible alternative solutions.
Product images are to be considered for illustrative purposes only.
Pursuant to Article 63 of the Consumer Code, any damage to the packaging must be contested immediately by placing a written reservation on the delivery document. In the absence of reservations, it will not be possible to raise objections relating to the external condition of the delivered goods.
If the carrier has been chosen by the customer outside those proposed by EQUIASA, the risk transfers to the customer at the moment of delivery to the carrier.
